Default Epilepsy driving laws? - 03-29-2008, 01:07 AM

I need to know, will I be able to drive in the U.K. after I have been seizure free for one year, I read the DVLA website, they say after one year i can drive a car or a motorbike, obviously after I have taken my CBT or full motorbike or got my car provisional. I am 18 by the way.
Thanks for the answers, by the way I have to tell insurance company or insurance will be invalid in an accident, which would incur the same crime as not having insurance.

Yes, and you can apply for your driving license in advance to begin from the date you last had a seizure (the year previous.) You need your doctor/specialist to send the Dela a letter.

Whatever the official line is, just make sure you are safe with it yourself, I have epilepsy and I used to drive but I don't anymore as a fit could be just around the corner, I was fit-free for about 5 years then I had one, granted, the chances that I would have had one at the wheel were extremely slight but I wasn't prepared to take the risk; have a good chat with your doctor about the type of epilepsy you have, mine is controlled by anti-convalescents, but that is not a promise of anything; I don't want to p i s s on your fire, but this is the reality, hopefully you have a mild form but whatever happens, you are your own person and you will get through this, good luck.

Don't tell your insurance company or your insurance will be extremely high. Also bare in mind epilepsy is like an earthquake and your on a fault line its not if its when could be a year could be a month.Watch your stress levels.

Firstly insurance. Technically you don't need to tell your insurance company (if you have a driving license), because DVLA have assessed that you have the minimum medical capacity required to drive. However, to be on the safe side you should tell the insurer. As you have a license it would be discrimination to penalize you with higher premiums just because of your epilepsy (which is a disability for the purposes of anti discrimination law).

The rules for driving after a diagnosis of epilepsy are quite complex. The fit free period will depend on the kind of fits you had (egg full tonic clinic seizures or lesser "space outs"), whether you tended to have them an night only or during the day, whether there was a known trigger that can be avoided, etc.

If you have been fit free for a year you may be entitled. Why not apply for a license, and see what happens. DVLA will ask for some medical details and will ask your doctor for a report. Generally, if you do get a license it will only last for 1, 2, or 3 years depending on who severe they think your condition is. You will then have to reapply, although it does not cost any extra for each re-application. If they think the epilepsy is never coming back you may eventually get a long term license. Otherwise you may have to re-apply regularly forever.
